Biology and Butterflies LLC

Multi-Environment Participation, Assumption of Risk & Liability Waiver

This Agreement applies to all Biology and Butterflies LLC programs, events, classes, birthday parties, outreach activities, demonstrations, or enrichment sessions regardless of location or setting. Programs may take place in public parks, private residences, schools, childcare centers, churches, community centers, classrooms, or outdoor natural environments.

1. Participation & Inherent Risk

I understand that Biology and Butterflies LLC provides interactive science-based programming for children that may include:

• Handling live insects such as caterpillars, eggs, and chrysalises

• Interaction with soil, seeds, plants, flowers, and natural materials

• Sensory materials such as kinetic sand, water, clay, or biodegradable materials

• Use of child-safe garden tools, scissors, glue, paint, and craft materials

• Outdoor learning activities involving walking, crawling, running, bending, lifting lightweight materials, or exploring nature-based spaces

I acknowledge that participation involves inherent risks that cannot be eliminated regardless of supervision.

2. Environmental & Biological Exposure

Participation may involve exposure to:

• Insects or insect bites or stings

• Native plants and plant sap (including but not limited to milkweed)

• Soil, pollen, seeds, flowers, and environmental allergens

• Uneven terrain such as grass, pavement, dirt, mud, or garden beds

• Weather conditions including heat, sun exposure, wind, humidity, or rain

• Wildlife commonly found in outdoor environments

Possible risks may include:

• Scrapes or bruises

• Allergic reactions

• Insect stings or bites

• Plant-related skin irritation

• Slipping or tripping

• Dehydration or heat-related illness

3. Assumption of Risk

I voluntarily allow my child to participate and fully assume all risks associated with participation in Biology and Butterflies LLC program activities in any indoor or outdoor setting.

4. Medical Conditions & Emergency Treatment

I certify that I have disclosed any relevant medical conditions or allergies.

I authorize Biology and Butterflies LLC staff to seek emergency medical treatment for my child if deemed necessary.

I understand that:

• Emergency services may be contacted

• I am financially responsible for any medical care rendered

• Biology and Butterflies LLC is not responsible for the outcome of any emergency medical treatment

5. Release of Liability

To the fullest extent permitted by Texas law, I release and waive any and all claims against Biology and Butterflies LLC and its owner, instructors, volunteers, contractors, partners, or affiliates arising from my child’s participation in program activities.

This release includes claims arising from the negligence of Biology and Butterflies LLC.

6. Indemnification

I agree to indemnify and hold harmless Biology and Butterflies LLC from any claims or damages resulting from my child’s participation in program activities.

7. Behavioral Expectations

If a child demonstrates behavior that poses a safety risk, they may be removed without refund.

8. Policy Acknowledgment

Participation in Biology and Butterflies LLC programming is subject to the current Enrollment, Attendance, and Refund Policy as outlined during registration.

9. Governing Law

This Agreement shall be governed by the laws of the State of Texas.
Any legal action shall be brought in Harris County, Texas.

10. Acknowledgment

By submitting this form, I confirm that:

• I have read and understand this Agreement

• I voluntarily agree to its terms

• I accept responsibility for my child’s participation
